本ソフトウェアをダウンロード、インストールまたは使用した場合、本契約に同意したものとみなされます。同意しない場合は、本ソフトウェアを使用しないでください。

1. 権利者と対象

本ソフトウェア、実行ファイル、ソースコード、文書、ロゴ、アイコンおよび同梱素材に関する著作権その他の権利は、Atlas Associates Inc.または正当な権利者に帰属します。本ソフトウェアはTakayuki Miyanoによって制作されました。本契約は所有権を利用者へ移転するものではありません。

2. 無償利用許諾

Atlas Associates Inc.は、利用者に対し、本ソフトウェアの正規版をAppleシリコンMac上で個人または法人の内部目的に使用するための、無償、非独占的、譲渡不能かつ再許諾不能の権利を許諾します。

3. 禁止事項

適用法令が明示的に認める場合を除き、利用者は次の行為を行うことができません。

- 本ソフトウェアの改変、翻案、リブランド、派生物の作成またはリバースエンジニアリング
- 実行ファイル、ソースコードまたは同梱素材の複製、再配布、ミラー提供、販売、貸与、譲渡または再許諾
- 著作権表示、制作者表示、商標、電子署名、ライセンス表示その他の権利表示の削除、隠蔽または変更
- 改変版または非公式版を、Atlas Associates Inc.もしくはTakayuki Miyanoによる正規版であると表示する行為
- Atlas Associates Inc.の名称、ロゴまたは商標を、本ソフトウェアの利用許諾を超えて使用する行為

第三者へ紹介する場合は、ファイルを再配布せず、公式配布ページへのリンクを共有してください。

4. 録画データ

本契約は、本ソフトウェアを使って利用者が作成した録画データの権利をAtlas Associates Inc.またはTakayuki Miyanoへ移転させるものではありません。録画対象の著作権、プライバシー、肖像権、契約および法令を確認する責任は利用者にあります。

5. アップデートと終了

Atlas Associates Inc.は、本ソフトウェアの提供、機能、更新またはサポートを変更もしくは終了できるものとします。利用者が本契約に違反した場合、本利用許諾は終了し、利用者は本ソフトウェアの使用を中止し、保有する複製物を削除しなければなりません。

6. 無保証

本ソフトウェアは、適用法令で許容される最大限の範囲で「現状有姿」で提供されます。Atlas Associates Inc.およびTakayuki Miyanoは、商品性、特定目的適合性、権利非侵害、継続利用、録画結果、データ保存またはエラーがないことについて、明示または黙示を問わず保証しません。

7. 責任制限

適用法令で許容される最大限の範囲で、本ソフトウェアの利用または利用不能から生じるデータ損失、録画失敗、逸失利益その他の直接・間接・特別・付随的または結果的損害について、Atlas Associates Inc.およびTakayuki Miyanoは責任を負いません。強行法規により責任を排除できない場合、その法令が認める範囲に制限されます。

8. 準拠法と管轄

本契約は日本法に準拠します。本契約または本ソフトウェアに関する紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。ただし、適用される消費者保護法その他の強行法規を排除するものではありません。

9. 言語

以下の英訳は参考のために提供されます。日本語版と英訳に相違がある場合、適用法令で認められる範囲で日本語版が優先します。

By downloading, installing, or using the Software, you agree to this Agreement. If you do not agree, do not use the Software.

1. Ownership and scope

The Software, executable, source code, documentation, logos, icons, and bundled assets are owned by Atlas Associates Inc. or their respective lawful owners. The Software was created by Takayuki Miyano. No ownership is transferred to the user.

2. Free license grant

Atlas Associates Inc. grants the user a royalty-free, non-exclusive, non-transferable, and non-sublicensable license to use an official copy of the Software on Apple silicon Macs for personal use or internal business use.

3. Restrictions

Except where applicable law expressly permits otherwise, the user may not modify, adapt, rebrand, reverse engineer, create derivative works from, copy, redistribute, mirror, sell, rent, transfer, or sublicense the Software or bundled assets. The user may not remove, conceal, or alter copyright notices, creator attribution, trademarks, digital signatures, license notices, or other proprietary notices. The user may share a link to the official distribution page instead of redistributing the files.

4. Recordings

This Agreement does not transfer rights in recordings created by the user to Atlas Associates Inc. or Takayuki Miyano. The user is responsible for complying with copyright, privacy, publicity, contract, and other applicable laws relating to recorded content.

5. Updates and termination

Atlas Associates Inc. may change or discontinue the Software, updates, features, or support. This license terminates upon breach, after which the user must stop using and delete all copies of the Software.

6. Disclaimer and limitation of liability

To the maximum extent permitted by law, the Software is provided “AS IS,” without warranties of any kind. Atlas Associates Inc. and Takayuki Miyano are not liable for lost data, failed recordings, lost profits, or any direct, indirect, special, incidental, or consequential damages arising from use or inability to use the Software. Liability that cannot be excluded is limited to the extent permitted by applicable law.

7. Governing law and jurisdiction

This Agreement is governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance, without excluding mandatory consumer protection or other non-waivable laws.
